Gambling domain name ‘infringing casino’s trademark’

Las Vegas casino operator Boyd Gaming Corp. is suing a domain name holder for trademark infringement, it has been reported.

According to the Las Vegas Sun, the firm has accused Austria-based Hans Martin Pollack of misusing its Stardust trademarks for online gambling portals.

An infringement complaint was filed in the U.S. District Court in Nevada over Pollack’s domain names stardustgaming.com and stardustgaming.net.

Boyd Gaming Corp. is attempting to gain control of the Web addresses to prevent them from being misused, the news provider stated.

“The defendant is exploiting the plaintiff’s good will and seeking to capitalize upon consumer confusion,” the lawsuit alleges.

“Since the Stardust property first opened in 1958, millions of visitors throughout the United States have visited and seen the Stardust property and Boyd’s other properties that continue to use the Stardust marks.”

Earlier this week, it was revealed that Caesars Palace owner Caesars Entertainment Corp. is locked in a legal battle with Florida man Marcel July over the Octavius Tower trademark.
