A US court has given Gucci permission to sue an apparel retailer over the sale of counterfeit products, it has been reported.
According to Reuters, US District Judge Shira Scheindlin in Manhattan said the Italian luxury goods company is entitled to pursue claims of trademark infringement.
Guess Inc is accused of copying four Gucci designs, including green-red-green stripes, a script logo and a group of four interlocking ‘G’s.
Judge Scheindlin said it was reasonable to assume that Guess acted in bad faith by developing designs that might cause confusion.
She noted that Gucci had produced evidence that the Quattro G design did cause “actual confusion” among customers, the news provider reported.
Robert Welsh, a lawyer for Guess, said the firm had not engaged in “willful deceit” over the designs in question.
And Gucci lawyer Louis Ederer declined to comment at this point in time.
